Workers' Compensation Defense

For the past fifty-five years, Stockwell has been representing employers, insurance carriers and third party administrators on a state-wide basis before the California Workers’ Compensation Appeals Board (WCAB), and the California courts including the Court of Appeals and the Supreme Court of California. Our practice areas further include employer representation before the WCAB defending Petitions alleging 132a violations, Serious and Willful Misconduct as well as prosecuting subrogation claims against third parties.

At Stockwell, our attorneys implement aggressive defense strategies designed to reduce medical costs and to close files with expediency. In furtherance of these goals, Stockwell continues to be a pioneer in the prosecution of lien defense strategies and lien consolidated matters before the WCAB.

Subrogation

Our team of subrogation experts routinely handles California subrogation matters including insurance claims against adverse liability carriers, First Liens, and subrogation lawsuits. We have successfully recovered subrogation liens on claims ranging from general negligence to slip & falls, motor vehicle accidents, products liability, and intentional torts. Our subrogation attorneys have litigation experience from the initial filing of the Complaint all the way through Jury Trial, including post judgment procedures. The subrogation department is equipped to handle all aspects of a civil lawsuit including conducting written discovery, taking depositions, participating in mediations, arbitrations, settlement conferences, and all court hearings and Trials, including jury selection, onsite inspections, and selection of experts. We take care to closely work with clients in properly maintaining evidence, working with witnesses, and ensuring the best possible recovery outcome. Our subrogation attorneys also have experience with the Workers’ Compensation Appeals Board in handling third party credit issues and global settlements in connection with third party settlements. This cross-over experience enables our team to identify and align the goals and objectives of both the subrogation claim and the underlying workers’ compensation claim to obtain the best possible result for the client.
